A Hilo grand jury indicted a 41-year-old Hilo man accused of shooting his estranged wife at close range in their upper Kaiwiki Road home March 28.
The three-count indictment filed Wednesday charges Corey Napoleon with attempted second-degree murder, first-degree reckless endangering and use of a firearm in the commission of a felony.
Napoleon, who is morbidly obese and bedridden — reportedly unable to walk — is accused of shooting and critically injuring 35-year-old Miya Napoleon, also known as Miya Sagucio. According to documents, she told police Corey Napoleon was sitting at the edge of the bed and fired two rounds from a black revolver. One missed while the other hit her in the right side of the lower back.
The alleged victim in the reckless endangering charge is the couple’s 15-year-old son who, according to documents, told police that after the shots were fired, he wrestled the firearm away from his father and the gun again went off during the struggle. Neither the teen nor Corey Napoleon was hit.
Police said a .38-caliber revolver was recovered at the scene.
Corey Napoleon has a preliminary hearing scheduled for 2 p.m. April 29 in Hilo District Court, but the indictment serves as probable cause to hold him for trial, so the hearing won’t be held.
On April 1, Hilo District Judge Harry Freitas maintained Napoleon’s bail at $330,000.
According to the state Department of Public Safety website, Napoleon is being detained at Halawa Correctional Facility on Oahu, which has a medical unit. He will have to be flown to Hilo Circuit Court at some point to face arraignment and plea. A trial date likely will be set at that point.
The wounded woman’s sister, Emery Sagucio, set up a GoFundMe page titled, “Prayers for Miya Sagucio.” As of Thursday afternoon, the online fundraiser netted $5,020 of a $7,500 goal.
Sagucio’s latest entry on the page said her sister “is doing wonderful.”
“Through the grace of God, luck, bad aim, and her sheer will to not be defeated my sister was walking today,” she wrote. “The bullet that hit her missed her major organs, major vessels, and didn’t paralyze her. There are one or two more things we are waiting to see to determine if she will have a complete physical recovery or not. It’s absolutely amazing.”
