HCCC inmate accused of assaulting guard

A 23-year-old Hilo man has been charged with an assault on an adult corrections officer at Hawaii Community Correctional Center that resulted in the hospitalization of the victim, according to County Prosecutor Kelden Waltjen.

Marly M. Poai of Hilo was charged with first-degree assault. The complaint identifies the victim as Dylan Borges, and states Borges suffered “seriously bodily injury,” although those injuries weren’t described.

First-degree assault is a Class A felony that carries a maximum sentence of 10 years imprisonment, upon conviction. Bail on the charge was set at $25,000.

Poai was in HCCC in lieu of $207,000 bail on an unrelated matter, awaiting trial for a violent carjacking in November in the Panaewa area of Hilo. The victim in that case, a 66-year-old Pahoa man, was taken to The Queen’s Medical Center in Honolulu with multiple pelvic fractures, a spinal fracture and a ruptured bladder.

Poai has pleaded not guilty in that case to with first-degree robbery, kidnapping, first-degree assault, first-degree theft, unauthorized control of a stolen vehicle, leaving the scene of an accident involving serious injury, first-degree negligent injury, methamphetamine possession, reckless driving and first- and second-degree reckless endangering.

According to Waltjen, Poai, who was on probation on a previous conviction for second-degree assault, a Class C felony, and felony domestic abuse, and is facing probation revocation proceedings in that case, as well.

The complaint in the HCCC assault case said Poai could be sentenced to a mandatory minimum term of imprisonment without the possibility of parole as a repeat offender.

Poai was scheduled for an initial appearance Wednesday in Hilo District Court on the most recent charge.
