A 39-year-old Captain Cook man is accused of using his iPhone to take secret video of his girlfriend’s adult daughter while she was nude.
Frank K. Cantiberos is charged with first-degree invasion of privacy, a Class C felony punishable by up to five years imprisonment upon conviction.
According to court documents filed by police, the victim, a 23-year-old woman, called 911 at about 9:32 a.m. Tuesday to report that Cantiberos and her 44-year-old mother were involved in an active domestic dispute because of the alleged invasion of privacy, which occurred a short time earlier.
The victim told officers that she entered the bathroom in her Kailua-Kona home at about 8:05 a.m. to take a shower, and closed the bathroom door for privacy. The woman told police she went back to her bedroom about 15 minutes later and dried off.
The victim said she was completely nude when she saw a blue iPhone resting on a shelf, partially covered by a hat, with the camera pointed at the room.
According to the documents, the victim grabbed the iPhone, turned it around and noticed it was in recording mode. She then reportedly reviewed the video on the cellphone which, according to police, showed Cantiberos placing the iPhone on the shelf. The video recording later showed the victim’s breasts, the documents state.
The victim then confronted Cantiberos about videoing her in the nude, which she told police Cantiberos denied by saying he was attempting to capture a cane spider.
After reviewing the cellphone video, police arrested Cantiberos, who has no prior felony convictions. His bail was set at $5,000.
At Cantiberos’ initial court appearance on Thursday, Deputy Public Defender Nicole Hazlett asked Kona District Judge David Harada-Stone to free Cantiberos on supervised release — a form of cashless bail — or to reduce his bail, but Deputy Prosecutor Aaron Masser asked the judge to maintain Cantiberos’ bail at the same level.
Harada-Stone confirmed bail at $5,000 for Cantiberos — who has an active domestic case in Kona Family Court for misdemeanor terroristic threatening and petty misdemeanor property damage, with the 44-year-old mother in this case as the victim. In that case, Judge Joanna Sokolow ordered Cantiberos to stay at least 100 yards away from the older woman.
Cantiberos, who remains in custody at Hawaii Community Correctional Center, also was ordered to return Tuesday for a preliminary hearing in the invasion of privacy case.
