A judge declined a request for a bail reduction Monday for a 32-year-old Captain Cook man accused of taking part in a bizarre assault of three men early Sunday in a Kailua-Kona parking lot.
Deputy Public Defender Ann Datta asked Kona District Judge Joseph Florendo Jr. to reduce bail from $63,750 to $10,000 for Donoven Pogtis, but Deputy Prosecutor Kauanoe Jackson requested an increase in Pogtis’ bail.
Florendo increased Pogtis’ bail to $64,750 after adding $1,000 for two charges that didn’t have bail previously set.
The judge also ordered Pogtis, who’s in custody at Hawaii Community Correctional Center, to return Thursday for a preliminary hearing.
Pogtis is charged with attempted second-degree murder, unauthorized entry into a motor vehicle in the first-degree, auto theft, first-, second- and third-degree assault, first-degree terroristic threatening, reckless driving, leaving the scene of the accident, and failure to give information and render aid.
He’s one of three men police say assaulted the three victims— two 19-year-old men and a 29-year-old man — at about 2 a.m. Sunday.
According to police, the suspects stole and drove away in the victims’ car. The suspects later returned to the scene, where the they struck one of the victims with the car before hitting another vehicle and a building.
The 29-year-old victim was taken by ambulance to Kona Community Hospital, where he was treated for his injuries and later released.
Neither of the 19-year-old victims were seriously injured.
Pogtis and two other men, 19-year-old Landon Pogtis and 20-year-old Todd Cabanlet, turned themselves in to police at about 3 a.m. Sunday.
According to police, Cabanlet was charged with second-degree terroristic threatening and two counts of third-degree assault.
His bail was set $1,500, which he apparently posted, as the Hawaii Judiciary website doesn’t list his case or a court date for him.
Landon Pogtis was released pending further investigation, police said.
