Settlement reached in company’s information breach

A proposed $725,000 settlement has been reached in a class-action lawsuit against FCH Enterprises — the owners of Zippy’s Restaurant and Napoleon’s Bakery — related to a breach of the company’s credit and debit card processing systems between Nov. 23, 2017, and March 29, 2018.

The incident may have resulted in the “potential exposure of payment card data,” including credit card numbers, expiration dates and magnetic stripe security codes, from customers who used a credit or debit card during that time, the settlement notice states.

The proposed settlement includes all U.S. residents who used a credit or debit card at the FCH restaurants, which also include Kahala Sushi, Pearl City Sushi and Pomaikai Ballrooms locations, in that period.

Those seeking payment from the settlement have until June 2 to submit a valid claim form. Claim forms can be found online at zippyssettlement.com or by calling 1-888-906-2033.

Awarded amounts will depend on the number of valid claims submitted and whether victims suffered unauthorized charges on their credit or debit cards that were “plausibly connected” to the breach.

Those who want to opt out of the suit can mail a signed, written request asking to be excluded from the settlement class along with a name, address and phone number to FCH Enterprises Claims Administrator, c/o CPT Group, Inc., 50 Corporate Park, Irvine, Calif. 92606 by April 3.

April 3 also is the deadline to object to the settlement.

By doing nothing, settlement class members will receive no payment and forego the right to sue over claims resolved by this settlement.
