HONOLULU (AP) — A Hawaii appeals court has overturned the three consecutive life prison terms for the man convicted in a road shooting that killed a mother of 10.
Last month’s ruling gives Toby Stangel hope that he could someday go free.
The court ruled that a judge’s decision to stack Stangel’s life terms, instead of concurrent sentencing, was based on an unsubstantiated assumption. The court says the judge made an assumption about the amount of years Stangel was illegally carrying a gun.
Stangel’s defense attorney has said his client was hearing voices when he went on a 2011 highway shooting rampage. Tammy Nguyen was killed and two other motorists were shot and wounded.
The state says it plans to against ask for consecutive life prison terms.
